5. Ordering, Payment, and Pricing Terms
5.1 Order Placement and Acceptance
When you place an order through our Website or any authorized ordering platform, you are making an offer to purchase the selected products. An order is not confirmed until you receive an order confirmation from Pizza Luce, either via email, on-screen notification, or other written confirmation. We reserve the right to accept, refuse, or cancel any order at our discretion, including but not limited to situations involving product unavailability, pricing errors, or suspected fraud.
5.2 Pricing
All prices listed on our Website are in United States Dollars (USD) and are subject to change without notice. Prices displayed do not include applicable federal, state, or local taxes, or delivery fees, unless explicitly stated. Sales tax will be calculated and applied at checkout in accordance with applicable law.
5.3 Payment Methods
We accept various forms of payment as indicated on the Website at the time of checkout, which may include major credit cards, debit cards, digital wallets, and gift cards. By providing payment information, you represent and warrant that:
- You are authorized to use the payment method provided;
- The payment information is accurate and complete;
- You authorize Pizza Luce to charge the applicable amount to your designated payment method.
All payments are processed through secure, third-party payment processors. Pizza Luce does not store complete credit card information on its servers.
5.4 Refunds and Cancellations
Due to the perishable nature of our food products, all sales are generally final once an order has been prepared. If you experience a quality issue or receive an incorrect order, please contact us promptly at [email protected]. Refunds or credits are issued at our sole discretion on a case-by-case basis. Cancellation requests must be submitted before the order has been confirmed and preparation has begun.
5.5 Gift Cards
Gift cards are non-refundable, have no cash value except where required by law, and cannot be redeemed for cash unless required by applicable state law. Lost, stolen, or damaged gift cards will not be replaced. Pizza Luce is not responsible for unauthorized use of gift card balances.
6. Delivery and Pickup Services
Delivery availability, minimum order amounts, delivery fees, and estimated delivery times vary by location and are subject to change. Delivery times are estimates only and not guaranteed. Pizza Luce shall not be liable for delays caused by circumstances beyond our reasonable control, including but not limited to traffic conditions, weather events, or third-party delivery service issues.
You are responsible for providing a complete and accurate delivery address. Pizza Luce is not responsible for orders delivered to incorrect addresses provided by the customer. If a delivery attempt is unsuccessful due to no fault of our own, a refund may not be issued.
For pickup orders, you must retrieve your order within a reasonable time of the indicated pickup time. Pizza Luce is not responsible for the quality of food that has been left uncollected for an unreasonable period.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the fullest extent permitted by applicable law.
9. Indemnification
You agree to defend, indemnify, and hold harmless Pizza Luce and its officers, directors, employees, contractors, agents, affiliates, successors, and assigns (collectively, "Indemnified Parties") from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

Pizza Luce does not endorse, control, or assume any responsibility for the content, privacy practices, or policies of any third-party websites or services.
Your use of third-party websites and services is at your own risk and subject to the terms and conditions and privacy policies of those third parties. We strongly encourage you to read the terms and privacy policies of any third-party service you visit.
Pizza Luce shall not be liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites.
12. Governing Law and Jurisdiction
These Terms of Service and any dispute or claim arising out of or related to them, their subject matter, or their formation shall be governed by and construed in accordance with the laws of the United States of America and the laws of the applicable state in which Pizza Luce operates, without regard to conflict of law principles.
To the extent any dispute is not subject to mandatory arbitration under Section 13 below, you consent to the exclusive jurisdiction of the federal and state courts located within the state in which Pizza Luce's principal place of business is located for the resolution of any disputes arising out of or related to these Terms or the Services.
You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts. These Terms shall not be governed by the United Nations Convention on Contracts for the International Sale of Goods.
13. Dispute Resolution and Arbitration
13.1 Informal Resolution
Before initiating any formal legal proceedings, you agree to first attempt to resolve any dispute informally by contacting Pizza Luce at [email protected] and providing a written description of the dispute, the relief you are seeking, and your contact information. We will attempt to resolve the dispute informally within thirty (30) days of receiving your notice.
13.2 Binding Arbitration
If we are unable to resolve the dispute informally within thirty (30) days, you and Pizza Luce agree that any and all disputes, claims, or controversies arising out of or relating to these Terms, the Website, or the Services (including the formation, performance, and alleged breach of these Terms) shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association (AAA) pursuant to its Consumer Arbitration Rules, which are available at www.adr.org.
The arbitration shall be conducted in English by a single arbitrator. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court having jurisdiction thereof.
13.3 Class Action Waiver
13.4 Exceptions
Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to protect its intellectual property rights or confidential information, pending final resolution of a dispute through arbitration.
13.5 Small Claims Court
Either party may bring an individual action in small claims court for disputes or claims that fall within the scope of that court's jurisdiction, provided the action remains in small claims court and is not removed to another court.
14. Term and Termination
These Terms shall remain in full force and effect for as long as you access or use the Services. Pizza Luce may, in its sole discretion and without prior notice or liability, suspend, restrict, or terminate your access to the Services or your account at any time, for any reason, including but not limited to:
- Your breach or violation of any provision of these Terms;
- A request by law enforcement or government authorities;
- Discontinuation or material modification of the Services;
- Unexpected technical or security issues;
- Suspected fraudulent, abusive, or illegal activity on your account.
You may terminate your account at any time by contacting us at [email protected]. Upon termination, your right to use the Services will immediately cease. Provisions of these Terms that, by their nature, should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification obligations, and limitations of liability.
Pizza Luce shall not be liable to you or any third party for any termination of your access to the Services.
15. Changes to Terms
Pizza Luce reserves the right, at its sole discretion, to modify, amend, or replace these Terms at any time. When we make changes, we will:
- Update the "Last Updated" date at the top of this page;
- Post the revised Terms on our Website;
- Where required by applicable law, provide additional notice, such as sending an email to the address associated with your account.
It is your responsibility to review these Terms periodically for changes. Your continued use of the Website or Services after any modification to these Terms constitutes your binding acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Services.
For material changes that significantly affect your rights, we will provide at least thirty (30) days' advance notice before such changes take effect, either by posting a prominent notice on the Website or by sending a direct notification to you.
16. Severability
If any provision of these Terms is found by a court of competent jurisdiction or an arbitrator to be invalid, illegal, unenforceable, or in conflict with any applicable law, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable, or if modification is not possible, it shall be severed from these Terms.
The invalidity or unenforceability of any provision shall not affect the validity or enforceability of any other provision of these Terms, all of which shall remain in full force and effect. The parties agree that the remaining provisions shall be interpreted so as best to effectuate the original intent of the parties.
17. Entire Agreement and Waiver
These Terms, together with our Privacy Policy and any other legal notices or agreements published by Pizza Luce on the Website, constitute the entire agreement between you and Pizza Luce with respect to your use of the Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Services.
No waiver of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Pizza Luce to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
These Terms may not be amended except as expressly provided herein or by a written agreement signed by an authorized representative of Pizza Luce.
18. Force Majeure
Pizza Luce shall not be liable for any delay or failure to perform its obligations under these Terms to the extent such delay or failure is caused by events beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemic or epidemic events, war, terrorism, riots, government actions, labor disputes, power outages, internet or telecommunications failures, or supply chain disruptions. In such events, our obligations will be suspended for the duration of the force majeure event.
